Tobacco Under FDA? In Congress.

The Washington Post is reporting that members of Congress are introducing legislation to bring tobacco products under the control of the Food and Drug Administration.

While the article didn't address it, I thought cigars would not be under the FDA as cigarettes. But if Waxman is for it, I'm pretty much against it.

Then again, maybe once it's under FDA control they'll use FDA rules and regulations on deciding actual dangers and levels of acceptable exposure and find out all this hysteria is BS and it'll backfire on the smoke Nazis.

I'm just waiting to see if with the FDA in charge I can use the Americans with Disabilities Act to get smoking sections put back in restaurants and bars.

Your not far off from the truth. ASH (americans smokers blah something something) sued OSHA several years ago trying to force them to ban smoking in all workplaces nationwide. OSHA said fine, we'll do and go by the best science available. Essentially it would have made it illegal to ban smoking because SHS doesn't (not even close) exceed PELs. ASH dropped the suit when they realized it would have handcuffed them.

The one thing none of the anitis won't talk about his how OSHA plays in bans. It the one agency that has the power to ban indoor smoking. They won't and can't, because by their guidelines - it poses no risk. In order to get a "deadly toxic" dose of chemicals from SHS - you would have to smoke a 100,000 cigarettes at the same time in an enclosed room with no ventilation (or 2 cigars ).
